How long have I got to claim personal injury compensation?
Normally, you have three years from the date of injury or, where there is no clearly identifiable injury date (workplace illnesses, for example), three years from the date you thought you may have a claim, to issue court proceedings. However, certain types of injuries have shorter time limits. So, if you think you may have a claim, it is vital you seek legal advice as soon as possible.
How do I start a personal injury claim?

How much is my personal injury claim worth?
Each case is different, so the amount of compensation you could get depends on a number of things, like the severity of your injuries, whether you receive rehabilitation or medical treatment and what expenses you incur because of your injuries.

What can I claim for?
Whilst compensation is usually paid in one lump sum, it can be made up of two elements. The first element reflects the pain and suffering you have experienced as a result of your injuries, as well as how your injuries have affected your way of life. Compensation paid to reflect this first element is called ‘general damages.’
The second element is the financial expenses and losses incurred or resulting from the injuries (things like medical treatment costs or loss of earnings). Compensation paid in relation to this second element is called ‘special damages.’
How long will my personal injury claim take?
That depends on the severity of your injury or illness, whether you require any rehabilitation and medical treatment, and whether the party responsible has admitted fault (“liability”). A straightforward claim may take 6 to 12 months to complete. If liability is disputed, or you need rehabilitation and medical treatment, it could take 12 to 18 months. Complex cases can take significantly longer.
