New Road Traffic Collision Claims Process
From 31st May 2021, the personal injury claims process has changed for people who suffered from low value injuries (including whiplash) in road traffic collision claims. This affects how much compensation you can receive, the amount of legal costs you can recover from the insurer of the driver responsible for your injuries, as well as how the claim is processed. Despite that, in most cases, we can still offer you a No Win No Fee. Find out more about the new claims process.
How long do I have to make a Road Traffic Collision claim?
Normally, you have three years from the date of your injury. However, certain types of claims (like if you were in a road traffic collision abroad) may have different time limits. So, if you think you may have a claim, it is vital you seek legal advice as soon as possible.

What if I was partly to blame for the collision?
You may be able to make a claim even if you were partly responsible, so it’s still worth talking to us to see. If you can make a claim, and are awarded compensation, your compensation is likely to be reduced by the percentage that you’re found responsible.
Can I make a claim if I wasn’t wearing a seatbelt?
It is a legal requirement to wear a seatbelt in a vehicle unless you’re exempt (e.g. if you’re a passenger on a bus not fitted with a seatbelt or you’re medically exempt), so you may think you can’t make a claim if you were involved in a road traffic collision and you weren’t wearing a seatbelt, but that’s not the case. You may still be able to claim if your injuries were caused by someone else’s fault. If you win your claim, your compensation is likely to be reduced by 25% if your injuries would have been avoided, or by 15%, if your injuries would have been less severe, had you worn a seatbelt. However, a Court can make whatever reduction it considers appropriate in the circumstances.
Can I make a claim if the offending vehicle is untraceable or uninsured?
If you suffer an injury in a road traffic collision and the driver at fault cannot be traced or is uninsured, you can still make a claim. The Motor Insurers’ Bureau is the body that has been set up to compensate victims of untraceable and uninsured drivers.
How much is my road traffic collision compensation claim worth?
